NSW Old Pacific Hwy mooney mooney- cops lose case

To me its helpful knowing what new tactics are in use up there,I would never never never overtake on double or solid lines obviously.Not even if someone,say an L paler was limping along well and truly under the limit for a very very long time.It would be funny to see the reaction of these monkeys doing there trap,coming up to them with a blinker on and turning right into a drive way.It sounds to me like someone with some clout got passed over double yellows and did some counter thumping up at Horsby cop shop.

  2. Hi, I'm "Tarded's" father and it was me and my brother that got booked for the same "overtaking over double lines" at Mooney Mooney as did you. I have contacted a lawyer and fellow bike rider who is very emphatic that this entrapment is illegal and the court would strike it down.     Thanks for the offer. At this stage I think I will pass though. As far as I know, entrapment / agent provocateur is not considered a valid defence in Australia. If it was then I would look a think a bit harder about it.

No worries, however you may wish to get some advice on the "entrapment" issue as our legal counsel is quite emphatic that "entrapment" is not legal in NSW and will be struck down in court particularly if there it can be shown the Police have used the trap repeatedly and unethically as is the case in this instance.

    Have a think about it and if you would like to join us you would be very welcome.

  5. i will be very interested to see the outcome of this court case. Ill bet a pie from the sky and diet coke that you loose in court. No matter what you and your lawyer says the cops will lie out of their arses and say that they were just driving on the speed limit minding their own business when u over took them on double yellows. The judge will look at a rider with his expensive lawyer in his nice suit and 2 coroborating cops with 20 years on the force and believe them. Trust me i have been there and done that. It made me realise that what really happened out there doesnt mean shit. If a cop wants to get on the stand and tell lies u are doomed. I was on the receiving end of 2 lying dirtbag cops earlier on in the year and they took my licence off me and made me have to drive carefully for 3 months until i got it back.....

  8. Went for a run up in a mates car yesterday arvo, didnt see any HWP besides one in the mooney rest area for the F3.

  9. I went up on Tuesday, saw a hpw car, an unmarked and an unmarked with 4 plain clothed inside. The last car followed me from brooklyn all the way to pits and pulled in behind, stopped for a while then took off again.

    Also I am pretty sure I overtook a xtrail or something very similar?? It was heading south and I caught up to it cruising along just after the bridge heading north shortly after PITS, I stayed behind it until the next straight with the broken lines and overtook it, it was weird as it began to speed up a bit and I just thought, f-wit speed up on the little straight bit. I would have hit 100 though and didn't think to look at the driver, focused on the road and the upcoming left hander around the rock face (few corners before the end)

    Also I heard about the crackdown on the weekend about fender eliminators. Nothing happening mid week. Week before I got booked in the RNP, I never go down there and didn't know the 50 zone was there past the centre down at Audely. I got done and must say I think partly because of my honesty,the policeman was very kind to me. No mention of fender eliminator either.

    I'm heading up for a ride on the old road again tomorrow morning.

  10. This is still going on. Good mate of mine is now a few hundred out of pocket after overtaking a small bronze box-car doing less than 50KPH thorugh some gentle bends.

  12. I did a few laps from the 60 zone past PITS to the bridge and back and was stuck behind a SUV which sat in the right lane going 70. I'm on my Ps so everything is at 80* anyway but I was a bit curious if it was a cop trying to get me to undertake.

    *one corner only at 70, but getting better!

  16. It's been well published how the police try and entice riders to break the law. This has been common practice of the Old Pacific Highway, Macquarie Pass and also the Putty Road. A few riders that were fined for overtaking a vehicle by crossing unbroken lines challenged the method used by police and have won in court. See attached article and video in this morning's SMH

  19. The police say they are going to continue to pursue dangerous driving practices. Isn't what they did dangerous driving. Perhaps they should give themselves tickets.

  20. When you go to this article - the video starts with an ad for the Victorian Cops.

    I love the comments made by the riders that the methodology the police use is "Morally bankrupt".

    I would love to know if the cops got disciplined over this one. Someone has given them a huge kick up the arse I hope.
